General Terms & Conditions of portal DrTuba.eu have been prepared in accordance with the Slovenian Consumer Protection Act (ZVPot) and the international codecs for e-business.
The portal DrTuba.eu (the "store", "we") is operated by Kajtar.SI, Andreja Draksler,s.p., a provider of e-business (hereinafter "Provider", "Dr.Tuba", "Kajtar.SI", "we"). Upon registration in the system drtuba.eu, visitors acquire a name that is equal to its e-mail address and password. Username and password unambiguously define and connect the data input. By registering, the visitor becomes a user and obtain the right to purchase.
General Terms & Conditions concerning the operation DrTuba.eu, user rights and business relationship between suppliers and buyers.
1. Media information
All pictures can be of symbolic nature. Pictures and other media informations are of exclusive ownership of Kajtar.SI and can not be used or manipulated in any way without our knowledge. Some pictures of kites are property of the brands involved and we obtained from official media sources.
2. Access to information
(Summary of the legislation)
Service is committed to the customer always provide the following information:
* A) user/company identity (name and place of business, number register)
* B) contact information, which enable rapid and efficient communication (e-mail, phone)
* C) the essential characteristics of goods or services (including after-sales service and guarantees)
* D) availability of products (each product or service that is offered in the site should be available in reasonable time),
* E) the terms of product delivery or execution of services (mode, place and date of delivery)
* F) All prices must be clearly and unambiguously defined and appears to be shown, or already include taxes and transport costs
* G) the method of payment and delivery
* H) the duration of supply
* I) the period within which it is possible to withdraw from the contract and conditions for withdrawal, and they are also about whether and how much the customer return,
* J) an explanation of the process with the complaint, including details of the contact person or department for contacts with customers.
3. Offer of Products
Due to the nature of business via the Internet to offer, DrTuba.eu updates and changes often and quickly.
Prices are represented as regular prices and online prices. Regular prices are generally recommended selling price of the manufacturer or importer or the charges that he set up service. Online price is the price that applies to buy online in the event of an immediate 100% payment.
4. Payment Methods
Service provides the following methods of payment:
* With transfer to a bank account of Provider (after the offer / invoice) (apply online price, any additional discounts, the cost of postage, unless otherwise specified, shall be borne by the buyer)
* Credit card payment (with online price, the cost of postage, unless otherwise specified, shall be borne by the buyer)
* Skrill/Paypal eBanking payments (with online price, the cost of postage, unless otherwise specified, shall be borne by the buyer)
The provider shall issue an invoice to the buyer, with broken down costs and instructions on how to withdraw from the purchase and return the product if necessary and possible.
Purchase agreement (contract) is electronically stored on the server provider and the customer accessible at all times in his user profile (with a click on the link in the e-mailed order confirmation or in My Profile).
Online price applies to all members of DrTuba.eu. Member of the club DrTuba.eu user becomes registered in the portal DrTuba.eu. Regular price is the price to unregistered users who want to buy in our offices and do not club members DrTuba.eu. Registration is possible during the purchase.
Prices are valid at the time of contract award and have a pre-determined force.
Prices are valid in the case of payment by the above methods of payment under the above conditions.
Despite enormous efforts to ensure the most up to date and accurate information, it may happen that the information on the price wrong. In this case, or in the event that the price of the article changed during the processing of orders, customer service will allow cancellation of the purchase, but will also offer customer service solutions, which will go to the mutual satisfaction.
Purchase agreement between the provider and the customer is entered into at the moment, the supplier confirms the order (the customer receives a message on the status - Order confirmed). From that moment, all prices and other terms are fixed and apply to the provider and consumer.
6. Purchase procedure
a. Order PENDING - after placing the order, the buyer is notified by e-mail that the contract was accepted to the queue. At this stage the buyer within one hour of the possibility to cancel the contract. Customer's web-site service is always available comprehensive information regarding the status and content of the contract.
b. Order CONFIRMED - If a customer order is not withdrawn, a contract for further processing, a supplier of contract review, check availability of items ordered and the order confirmed or rejected on the ground. The provider can check to ensure the accuracy of the information or call the customer to supply his contact telephone number. In approving the contract provider shall inform the customer by e-mail of the scheduled delivery time. The purchase contract between the buyer ordered products and shop at this stage sealed and valid.
c. Order IN PROCESS - We started to work on your order. Depending on the time and goods ordered we ship within 24 - 72 hours for individual customers.
d. Order IN TEST - Applicable only for replacement bladders and it means that the bladder is made and it is inflated overnight to ensure seal quality. If test is not successful we have the right to remove issues - by replacing valve (1x) or seal small holes (2x). If the bladder has more errors then it is destroyed and we make new one again.
e. Order SHIPPED - We shipped the goods. Various times of delivery applies, by the chosen shipping company. We can give no warranties on actual shipping times. In case you choose to ship to a temporary address we strongly advise that you check shipping times and choose express option. We are not responsible on any late delivery and we are not responsible on any additional costs if shipment is not on time to your address.
7. The right to cancel the purchase, the return of goods
The buyer can cancel the order and ask for a full refund if the order is not in status of processing.
The funds will be returned in 8 days after the goods are received.
Service will prepare the goods or services within an agreed timetable.
Sub-contractor for delivery is the Post of Slovenia (economy service only) or DPD, but the seller reserves the right to choose another delivery service, if this contract can be completed more efficiently.
Shipping costs differs on weight and number of the packages. We offer several shipping options:
- Economy Letter (cost effective air mail, very limited tracking & no insurance!, for small shipments up to 2kg)
- Economy Package Priority (air mail, with tracking and automatic insurance up to 4200€ for shippings in EU, insurance worldwide only on request)
- DPD (EU with tracking, automatic insurance up to 520€, possible to deliver worldwide). More insurance on request only.
- UPS Express (only by customer's request, basic insurence 100€ only, more insuance on request only)
Different limits and conditions may apply for chosen shipping option or country. Customs and other post shiping costs, far island shipping, or costs which may occour in the shipping proccess after pro-forma or order is paid, covers the buyer, if not stated otherwise.
We are not responsible for any damage or loss if the package is not insured. We will not cover any loss if the shipment is not insured.
Customer obligation is to check for the package external damage prior opening the package. Customer must file damage report on the If the package is damaged or the goods are damaged as soon as possible but no later than 3 days after package received.
Customer must send us hi-quality picture proofs of the damaged items and must store the goods as described in section 10. of this T&C.
With economy shipments we can issue only shipment tracking after 1 (one) month of non-delivery to the customer. The result waiting time may be of several weeks (up to 10 weeks) and with no guarantee that the shipment will be found or compaint solved in our favour!
9. Delivery Times
All goods are, unless otherwise specified and communicated, in stock.
Normal shipment of goods:
* 24-72h - goods are in stock, shipping within 24-72h.
* delays may happen if product is not in stock or in case of other unforseen event.
Shipping/ Goods recomended delivery/travel times (in working days):
- Slovenian Post Economy shipment, Business Package Priority (EU 3-8, Other Europe countries 6-14, International 8-28)
- DPD (EU varies per zones, 2-8, worldwide 4-12)
- UPS Express Saver (delivery next business day in EU, 2-5 days rest of the world)
The package is shipped when all items purchased from us, are in stock. Despite efforts to maintain a sufficient level of inventory is possible that what the article runs out. In this case, the buyer is informed of the date of delivery of product.
If the buyer does not agree with the new time of delivery or installation or his product can not be guaranteed in the long term, may buy part or in may cancel the order. If the buyer wants it to have items that are in stock send and missing items send later separately, buyer needs to cover additional shipping costs as well.
Return part or all of the proceeds shall be made in accordance with the rules on withdrawal from the purchase.
Despite the efforts that our site remains up to date as much as possible it may happen that we do not have any item in stock, despite the notice on the page. This is a pre-apologize for any inconvenience.
Please note that actual delivery times are dependant on the shipping company and may vary. All delivery times are only of informational purposes. We are not responsible if the shipping company did not deliver the goods in specified times and the refund is not possible in this case.
We send tracking numbers only on request. With economy the postman in your country should leave a notice in your mailbox. We advise, if the goods are not delivered in 6 days, you contact us for the tracking, to check where is the package.
All products and repair services have 1 year limited warranty for factory faults, if not specified otherwise.
By opening or using of Dr.Tuba products customer confirms that he/she fully understands instructional manuals and have the skills to properly install and use Dr.Tuba’s products.
We will not cover any user miss-use of any kind. We will not cover any un-insured shipping damage/costs of any kind. We can not cover the loss or the shipment if not insured!
Due to a specific product manufacturing processes and static effects, small imperfections in material or workmanship, glue residues, imperfectly cut edges, slight color derivations, small valve off-positionings and off-directions and similar issues can not be a subject of the warranty claim.
Normal wear and tear; Any rips, punctures, scratches or any other damage caused by foreign objects; Sun/UV, water, sand and wind affected degradation; Damage caused by misuse, hard crashes/impacts on any surface, abuse, neglect or user error; Damage caused by assembly or set up error; Damage caused by improper handling or storage; Damage caused by use in the waves or shore break; Damage caused by jumping; Damage due to excess inflation; Damage caused by any modification, or defacing the serial number; Damage caused by anything other than defects in material or workmanship.
Proofs must be in high quality pictures.
Customer must work closely and actively with Dr.Tuba, so that the claim is resolved as soon as possible.
Customer must store the claimed goods for 30 days after the closed claim in case new evidences emerge.
Should a product found to be defective by us, in it's sole discretion, we will decide to either repair or replace the defective item. We are not responsible for any other expenses or damages sustained as a direct or indirect consequence.
Should we decide the item is defective we will refund the return shipping charges in form of a store credit.
The warranty for any repaired or replaced equipment is accepted from the date of the original purchase only.
There are no warranties that extend beyond the warranty specified herein.
Dr.Tuba undertakes that he will carry obligations resulting from warranty conditions.
a. Replacement Bladders
Replacement bladders are made upon brand's original blueprints if not stated otherwise.
Warranty void if ordered bladders are made for prototype kite, pre-serie kite or demo kite, and not advised on correct lenghts and valve positions on such kite bladder.
When original valves are not available anymore, original valves are in bad quality, or we can't find exact valves, we have the right to use our own replacement valves, without prior notice. We guarantee proper functionality of the bladders where we had to replace original valves with our own or replacement ones. All bladders are Quality Control (QC) tested prior shipping. A 30 percent return fee applies on all our custom bladders as described in these terms.
UniPUMP one pump valves have 3 years of limited warranty for weld only.
We may advise or ask customer for the measures check to minimize all unclarities with the bladder blueprints. We are not responsible in any way if the customer did not take the measures correctly or sent us wrong measures.
Due to nature of the workmanship or welding processes there may be some standard welding derivations from original blueprint valve centre positions, but not more than 20mm.
There might be differences between original blueprints and the factory installed bladders.
From experiences we found that factory bladders can be made too tightly compared to outer skin of the kite, so that we have the right to make the bladder slightly longer and wider compared to original factory bladder or blueprint, but no more than 20mm in width and 50cm in lenght total. Knowing that, we can extend one pump valve positions accordingly.
We constantly update our bladder database to match factory bladders. But we are not responsible if original bladder blueprint measures are made too big by brand compared to factory bladders. In such case we can help by installing the bladders into the kite, customer needs to send to and pick up the gear at Dr.Tuba repair loft.
b. Replacement Adhesive Valves
Due to nature of the welding process there may be a small derivations in off-centre welding, but no more than 4mm.
11. Complaints and Disputes
Service respects the existing consumer EU protection laws. Some fees applies if goods are custom made, like all kite bladders, sewed lines or any other custom made product. Fees are described in section seven (7.) of this terms. Service, after all reasonable efforts to comply with their duty to establish an effective system for dealing with complaints and designate a person, which, in case of problems, the buyer can connect the phone or by e-mail. The procedure for submitting complaints is available on the website, easy to use and confidential.
Dr.Tuba will, within five working days confirming that he had received a complaint message to the buyer, how long it will be discussed and it constantly informed about the procedure.
Service is aware that the essential characteristics of consumer dispute, as far as judicial resolution, and its asymmetry between the economic value of the claim and the costs incurred in resolving the dispute. This is also a major obstacle to the consumer does not initiate proceedings before the court. Therefore, the provider seeks their best to resolve any disputes amicably.
Service is committed to sustainable protection of all personal user data.
Provider will use the personal data solely for the fulfillment of the contract (the sending of information material, tenders, invoices) and other necessary communication.
User data in no case be handed over to unauthorized persons.
For the protection of personal data is also responsible user in such a way as to ensure the security of your username and password.
Service users will be contacted by means of distance communication only if a user does not explicitly object.
Creative e-mails will contain the following elements:
* The sender is clearly evident,
* Various campaigns, promotions and other marketing techniques, will be marked as such. It will also clearly set out the conditions of participation in them
* To clearly presented manner unsubscribe from receiving advertisements
* Request user does not want to receive advertisements, the tender will respect you.
14. Cut Liability
Service is their best efforts to ensure promptness and accuracy of the information published on its pages. Despite this, however, the properties of products, delivery time or price change so rapidly that the provider fails to correct the information on the Internet. In this case, will the buyer is informed of changes and enable it to withdraw from the contract or replace the ordered product.
Although the Provider tries to provide accurate pictures of sale items, requires that all photographs is taken as symbolic. Photos do not guarantee product properties.
15. Final provisions
The contracting parties declare to have read the Terms & Conditions and understood its content. Representatives of the contracting parties undersign the agreement to express their free will to conclude the Terms & Conditions on behalf of the contracting parties.
In case of any unclarities or grammatical mistakes the provisions shall be interpreted by the purpose of that provision and by the meaning of certain word in Slovenian language.
This Terms & Conditions and its validity, construction and effect shall be governed by the Slovenian laws. Any disputes or claims arising out of or relating to this Terms & Conditions or any breach thereof shall be finally settled by the competent court in Ljubljana, Slovenia.
This Terms & Conditions can change without prior notice.
